The web servers providing connectivity for the host RealCart.com are protected computers as defined at 18 USC 1030(e)(2)(B).

The operators of RealCart.com will not give, sell, or otherwise transfer email addresses stored on any of our hosts to any other party for the purposes of initiating, or enabling others to initiate, electronic mail messages.

Sending unsolicited email advertisements to or through our facilities is strictly prohibited. This domain as well as many others have already publicly opted out from receiving email.

Use of our facilities constitutes your acceptance of our Terms of Use as defined below.

Fax / Email Address / SPAM Policy

The RealCart.com fax number is reserved for the sole purpose of transacting RealCart business. Any use not related to the business of RealCart.com is not an authorized use and subject to a charge of Five Hundred Dollars ($500.00 USD) per unauthorized use as outlined below.

Any email addresses ending in “@mail.realcart.com” may be used for the sole purpose of communicating with RealCart.com concerning RealCart sales or support matters or to discuss the software itself, the content of this web site or any other matter regarding RealCart.com’s products or services provided that:

The “From” (or “Reply to”) email address is a valid email address where you can receive a reply to your email.
The “To” address is an email address that belongs to RealCart.com or its sister sites.
The email, if sent as an “Opt Out” email, is one that we “opted into” to begin with.
Verification that someone at RealCart.com “opted in” will be required in the form of the date, time, place (web address where one of us “opted in”) and IP address we were using when we “opted in”.
The email, if sent as an email from an affiliate or associate of a company where we “Opted In”, is one that we “opted into” to begin with.
Verification that we “opted in” to your affiliate or associates site will be required in the form of the date, time, place (web address where we “opted in”) and IP address we were using when we “opted in” as well as a copy of said affiliate or associates privacy policy.
NOTE: Email addresses appearing on the pages of this web site are never used for opt-in and must not be “harvested” for bulk email usage. There is no need to prove “opt in” on harvested email addresses. Several addresses that were once used on our web site have been deactivated due to serious abuse by bulk email marketers.
The origin of the email is easily identifiable.
Use only YOUR OWN web site address in the email. No IP addresses or third party web addresses qualify as “YOUR OWN web site address.”
The email is not of an “adult nature” and depicts no nudity or profanity of any kind.
You acknowledge your agreement to these terms by sending email to RealCart.com email addresses. If you do not agree to these terms, you may not send email to any address at RealCart.com.

Failure to comply with above Terms

If you choose to send RealCart.com a facsimile transmission that does not pertain directly to the business of RealCart.com you may do so at a cost of Five Hundred Dollars ($500.00 USD) for each unauthorized fax transmission. If you do not agree to these terms, do not send unauthorized facsimile transmissions. By sending unsolicited fax transmissions to our facsimile number you are agreeing to these terms in their entirety.

If you choose to send RealCart.com an email that is not of a RealCart sales or support nature (e.g., “How does your software work.” -or- “How do you set up PayPal with RealCart.”) or if you choose to send us an email that does not pertain to the content of this web site or its sister sites, we will consider your email to be an unsolicited email. Further: If the email is that of a commercial nature (e.g. an offer to buy YOUR products or services, enter a contest, read your newsletter, etc...) then we will consider your email to be Unsoliceted Commercial Email (UCE).

If you send any RealCart.com email address an unsolicited email or an any other email that fails to comply with each and every one of the terms above we will consider the email to be an invitation by you, your company and/or customer for us to educate you, your company and/or customer as to why you should comply with the terms that were violated.

RealCart.com charges Five Hundred Dollars ($500.00 USD) for each unsolicited email that you send to each “@mail.realcart.com” email address. Since we do not enjoy receiving email from violators of our email policies you can avoid paying us fees by NOT sending us unsolicited email. It would also help to familiarize yourself with the laws regarding unsolicited email in the state of Oklahoma. The Oklahoma Statutes provide for the payment of damages in the amount of twenty-five thousand dollars ($25,000.00) per day for each day that you send email through our ISP’s email servers through our ISP ultimately to us. This remedy applies whether you are sending one email a day or 2,500 emails a day. (See: Oklahoma Statutes, Title 15 Section 776.1, 776.2, 776.3 and 776.4 for more info.)

Senders of Adult Related email and Demand for Payment

If you send RealCart.com “adult” related email of any kind containing nudity, vulgarity, profanity or any other content not suitable for children you agree to pay us double our normal rates for violating our email policies. If you violate our email terms we will send you a demand for payment. You will only recieve one demand for payment prior to our taking legal action against you. It would be in your best interest to take us seriously and pay it promptly.

Deactivated Addresses

Addresses that have been deactivated and removed from our web site due to abuse by bulk email marketers include, but are not limited to, the following:

Although the above addresses have been deactivated from use on our web site we still monitor these addresses for violations of our Terms of Use, the Federal C.A.N.-S.P.A.M. Act of 2003 as well as Oklahoma Statutes, Title 15, Section 776.

Sending email to ANY of these addresses is forbidden and will result in swift and decisive legal action. Do not send email to any of these addresses or any of the addresses that appear in the code comprising any of the pages contained within the RealCart.com web site. Sending emails to these addresses constitutes your full acceptance and agreement to the above Terms of Use. If you do not agree, DO NOT SEND EMAIL TO REALCART.COM
